Class Action Litigation
With 30 years of legal experience, Andry Law has acquired extensive skills in handling class action lawsuit cases. We have represented thousands of clients in local, State and National class actions.
Attorney Andry has been lead counsel in numerous class actions such as Sutton Steel v. Bell South Mobility, 875 So.2d 1062 (La. App. 2004), which was a case against Bell South Mobility a/k/a Cingular, for breach of contract for excessive billing by rounding up to the nearest minute. In Sutton Steel, the certified class included millions of individuals and businesses over nine states. He was also lead counsel in other similar cases, such as Sonnier v. Radiophone and Abrusley v. Centennial Wireless.
A class action lawsuit is brought by a group of individuals or businesses that serve as representative of the other members of a specifically defined class. For example, in Sutton Steel v. Bell South Mobility, Sutton Steel Inc. and Kate Davis served as representatives of the class of millions of individuals and entities that had a contract with Cingular for cellular phone service. Importantly, any judgements issued in a class action bind all of the class members as if they were a specifically named party in the class action.
Our firm takes pride in seeing clients receive the compensation they are entitled to by law. A class action provides a number of advantages over individual lawsuits, including less costly litigation, avoidance of incompatible court rulings in multiple cases, and a more efficient legal process. Often, legal expenses are too great for a single individual or small business to pursue a claim. A class action lawsuit allows people to seek justice and compensation who otherwise would not be able to do so. A class action is best when a class of people experience similar harm or unfair treatment from a company or industry.
A class action lawsuit may address many different types of issues involving company negligence or wrongdoing, such as:
- Toxic waste dump
- Illegal consumer practices
- Dangerous pharmaceutical drugs
- Defective products
- Employment discrimination
- Unfair business practices
The suit may pursue compensatory damages such as pain and suffering, loss of life, illness, financial loss, or property damage along with punitive damages for illegal or criminal acts that harm health or safety.
Business torts can also affect one individual or a group of entities, and can often be treated as class actions when the same conduct impacted a significant group of individuals and/or entities.
